David Resnick & Associates, P.C., a personal injury law firm serving clients throughout New York City, announced that trial attorney Philip Monier secured a $2,500,000 pre-trial settlement for a Bronx woman who suffered catastrophic injuries when a commercial vehicle struck the vehicle she was driving.

The lawsuit was filed in the Supreme Court of the State of New York, Bronx County, seeking compensation for serious injuries the 43-year-old woman sustained in the truck crash. These injuries included a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures. The woman also suffered herniations and protrusions at multiple levels of her spine, along with nerve damage, leaving her permanently disabled and unable to work, according to the federal government.

Before the accident, the woman worked as an occupational therapy assistant, a physically demanding job that required helping patients with balance and strengthening exercises and lifting some patients weighing 200 pounds or more. Her injuries limited her ability to perform daily activities such as walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores.

“The physical toll of the crash was devastating, requiring our client to undergo major surgical intervention and face an incredibly challenging road to recovery,” Mr. Monier said.

The defense was prepared to argue that the woman's injuries were pre-existing and not caused by the crash, and that she was not disabled or impaired because any injuries stemming from the accident had fully healed. However, David Resnick & Associates, P.C., was prepared to argue that the accident was a substantial factor in causing her injuries and that any pre-existing conditions were exacerbated by the collision. The firm also intended to show that the woman remained permanently disabled and would require ongoing treatment and future surgical care.

“By securing this substantial settlement, we were able to provide our client with the financial peace of mind she deserves,” Mr. Monier said. “These funds will help her cover ongoing medical care, specialized rehabilitation, and the long-term support she will require to heal.”

This settlement is part of a series of notable results for the firm. Mr. Monier recently obtained a $1.925 million settlement in a staircase slip and fall case, announced June 20, 2026, and a $1.3 million settlement for a client injured in a fall outside an elevator, announced July 25, 2026.
