Alabama families considering stepparent adoption now face significant new requirements under Act 2025-407, part of the newly enacted Alabama Minor Adoption Code (Ala. Code § 26-10E-26). The law, which took effect in 2025, introduces a mandatory one-year residency period, expanded background checks, and formal home safety inspections, marking a major shift from the historically simpler stepparent adoption process.

Background checks have been expanded: every household member aged 14 and older must be cleared through Adam Walsh Child Protection checks and a search of the Dru Sjodin National Sex Offender Public Website. Additionally, a formal home safety inspection is required to confirm the residence is suitable for the child.
