New York Woman Secures $1.925 Million Settlement for Slip-and-Fall Injuries on Wet Staircase

David Resnick & Associates, P.C., a New York personal injury law firm, has secured a $1.925 million settlement for a 38-year-old woman who sustained catastrophic injuries in a slip-and-fall accident on a wet staircase in her building. The settlement was obtained before trial by attorney Philip Monier, who has over 25 years of experience representing accident victims.

The lawsuit, filed in the Supreme Court of the State of New York, New York County, alleged that the building owner and managing agent failed to maintain safe conditions on the stairs, leading to the woman's fall. According to the law firm, the woman suffered tears in the labrum of both hips, as well as injuries to her spine and neck. The accident caused her to go into induced labor, and she required surgical treatment and extensive rehabilitation. For several months, she was confined to rehabilitation services and needed surgery to repair the tears in both hips.

The injuries significantly impacted her daily life, limiting her ability to walk, bend, sit, perform household chores, or enjoy activities with her children. The building owner and managing agent argued that the fall occurred during a period of snow and cold weather, claiming they were not required to cover all floors with mats or continuously remove moisture. They also asserted they did not create the wet conditions and lacked notice of them.

Monier stated, 'We were prepared to call medical and economic experts to demonstrate to the jury the extent of this lovely woman's injuries and the effect they have had, and will continue to have, on her life.' He emphasized that when negligence causes an accident, the injured party deserves full compensation for past and future suffering. 'The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties,' he added.

The case underscores the responsibility of property owners to maintain safe premises, even during inclement weather. The settlement provides financial relief for the victim's ongoing medical needs and lost quality of life.
